These Terms & Conditions (“Terms”) govern your use of the Veritiefx Photography website located at veritiefx.com (“the Website”) and any application submitted through it to collaborate on photography projects with Veritie, a photographer based in Chirpan, Bulgaria (“the Photographer”, “we”, “us”, or “our”).

By accessing the Website, submitting an application, or participating in a photography session, you agree to be bound by these Terms. If you do not accept these Terms in full, you must not use the Website or submit an application.

These Terms are governed by the laws of the Republic of Bulgaria. This Website is intended solely for persons located within the European Union. It is not directed at, and must not be used by, any person located outside the EU, including but not limited to residents of the United States of America (including California), the United Kingdom, or any other non-EU jurisdiction.

There is no minimum age requirement to apply or participate in a photography session; however:

• Applicants who are 18 years of age or older may apply and participate independently.
• Applicants under the age of 18 may apply and participate only with the prior written consent of a parent or legal guardian. By submitting an application on behalf of a minor, the consenting parent or legal guardian confirms they have legal authority to do so and accepts these Terms on the minor's behalf.

By submitting an application you confirm that either (a) you are 18 or older and legally capable of entering into a binding agreement, or (b) you are a parent or legal guardian completing the application on behalf of a minor with full parental consent.

Photography sessions arranged through this Website are, unless otherwise explicitly agreed in writing prior to the session, unpaid creative collaborations operating on a Trade for Portfolio (“TFP”) basis. “Trade for Portfolio” means that neither party provides monetary compensation; instead, the Photographer provides professionally edited images and the applicant provides their time.

No monetary compensation is offered, promised, or implied by the submission of an application or confirmation of a session unless a separate written agreement expressly providing for payment has been executed by both parties before the session takes place.

Submission of an application does not constitute acceptance or confirmation of a session. All applications are reviewed personally and only a limited number are selected.

Photography sessions take place in and around Chirpan, Bulgaria, in locations agreed in advance by both parties. Sessions are conducted professionally and in safe, mutually agreed settings.

Either party may end a session at any time and for any reason without liability. The Photographer reserves the right to refuse or discontinue any session if, in their reasonable judgement, conduct is inappropriate, unsafe, or inconsistent with a professional creative environment.

Applicants are responsible for any travel costs incurred in attending a session. Travel from nearby towns and cities is welcomed.

The Photographer retains full copyright in all photographs produced during a session under these Terms. This includes but is not limited to rights of reproduction, distribution, display, and adaptation under Bulgarian copyright law (Zakon za avtorskoto pravo i srodnite mu prava) and applicable EU directives.

Following a session, selected participants will receive a curated set of professionally edited images (“the Portfolio Images”) for their own personal portfolio use. Unless a separate written licence agreement provides otherwise, the Portfolio Images are provided for personal, non-commercial portfolio use only. You may not sell, license, or commercially exploit the Portfolio Images without the prior written consent of the Photographer.

The Portfolio Images may carry a small watermark applied by the Photographer. Removal, alteration, or obscuring of any watermark is not permitted without prior written consent.

You grant the Photographer an irrevocable, worldwide, royalty-free licence to use your likeness as captured in the photographs produced during a session for the following purposes:

• Portfolio display (online and in print)
• Marketing and promotional materials
• Social media content
• Editorial and artistic publication

The Photographer will not sell or license your likeness to third parties for commercial advertising campaigns without your separate, explicit written consent.

By submitting an application and confirming participation in a session, you (or, in the case of a minor, the consenting parent or legal guardian) consent to the Photographer's use of your likeness as set out in Section 5 above. This constitutes a model release for the purposes described. A separate model release document may be presented for signature prior to or at the session; by signing it you confirm this consent in a standalone form.

By submitting an application, you represent and warrant that:

• all information provided in the application is accurate and truthful;
• the photographs submitted with the application are of you and are recent, unaltered images;
• you have the right to grant the consents described in these Terms and, where applicable, have obtained the valid written consent of a parent or legal guardian;
• your participation will not infringe any third-party rights.

To the maximum extent permitted by the mandatory provisions of Bulgarian law and applicable EU consumer protection legislation:

• The Photographer's total aggregate liability arising out of or in connection with these Terms, the Website, or any session shall not exceed the greater of (a) any amount actually paid by you to the Photographer (which, in the case of a TFP session, is zero) or (b) €100.
• The Photographer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of opportunity, or reputational harm.
• Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under Bulgarian law or mandatory EU law.

You acknowledge that sessions take place voluntarily and that by confirming participation you accept reasonable risks inherent in any photography session, including travel to agreed locations. You waive, to the fullest extent permitted by Bulgarian law, any claims arising from such inherent and accepted risks.

All content on this Website, including text, photographs, graphics, logos, and software, is the property of the Photographer or their licensors and is protected by Bulgarian and EU intellectual property law. You may not copy, reproduce, distribute, or create derivative works from any Website content without prior written consent.

We reserve the right to amend these Terms at any time. Material changes will be notified by updating the effective date at the top of this document and, where practicable, by a prominent notice on the Website. Your continued use of the Website following publication of amended Terms constitutes acceptance of those amendments.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict-of-laws rules. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent Bulgarian courts, save for any rights you may have as a consumer under mandatory EU law to bring proceedings in the courts of your habitual residence.
